If Judge O’Connor’s decision ultimately stands, about 17 million Americans will lose their health insurance, according to the Urban Institute, a left-leaning think tank. V. CONCLUSION:

For the reasons stated above, the court grants Plaintiffs partial summary judgement and declares the Individual Mandate, 26 USC.§ 500A(a) UNCONSTITUTIONAL. Further, the Court declares the remaining provisions of the ACA, Pub. I. 111-148, are INSEVERABLE and therefore INVALID. The Court GRANTS Plaintiffs' claim for declaratory relief in Court 1 of the Amended Complaint.
