lol yeah, what he said. Am expecting the ban to given an extra game. I'll gladly eat humble pie if the suspension is reduced and bow to phelan_shorts who said it will be overturned on appeal. However, from the time we heard they were looking into it I said he'll definitely get charged and now I feel he'll definitely get an extra game. Paranoia, conspiracy theory, whatever it is - just how I feel they'll rule.
 
I don't think the frivolous appeal issue will be an issue in this case.

Frivolous appeals are usually those that delay the imposition of a ban in order to allow the player to feature in a match. For example if we were playing tonight, appealing would mean a hearing tomorrow so he'd be able to play tonight. That's frivolous because the appeal is being used as a delay tactic rather than as a genuine belief that the appeal is worthwhile.

In this instance, there is nothing gained by delaying the outcome of the hearing 24 hours, so it makes no difference. It will be either the much discussed 2 games or reduced on appeal.

Manchester United have submitted an appeal on behalf of Wayne Rooney following the striker's 2-match suspension. The FA have confirmed Rooney has accepted the charge of 'offensive, insulting and abusive language', but appealed the severity of the 2-game ban...
 
It would probably have been a frivolous appeal had they not accepted the charge, but that is not the case. Rooney and United have accepted the charge, they only appeal the lenght..

The sensible thing for the FA (cnuts) would be to reduce it to one game with a 2 game suspended banning for future conduct.
 
i reckon theres been just enough negative comment in the media about the severity of the ban for the FA not to see it as a frivolous appeal. And let's face it, the FA are completely driven by the media.
 
Why should he even have to accept the charge. What he's done does not deserve any ban at all. If we drop points vs Fulham the FA will probably be delighted.

True, but the FA does enjoy bending the rules when it involves united and rooney in particular, so better to accept.

Well yes, 0 games would be nice but the FA don't want to be shown to lose face on this one. There's zero chance the ban will be no games

Because he did use abusive language. No one else gets done for it, you know it, I know it. But he did, and their own rules allow them to charge him for it. There's no point in contesting that because we won't win in Kangaroo court.

They can't give him no games after having charged him with offensive/abusive language anyway (well, they could if we had contested the charge and not just the punishment).

I think the maximum he can be fined is two weeks wages.

I don't think he should be banned for any games either, it's a complete joke but I don't think the FA will bend to give NO ban.

Edit: like a previous poster just said, he's admited the charge so he will be banned for at least one game.
 
there is no chance the appeal will be over-turned we be lucky if he didn't receive an extra ban knowing the FA policy.....:rolleyes:

Not exactly. In Rio's case they saw it as a way for him to play in the game against City if he had accepted the charge, would have missed that game. A lot of people in the media again made that to be the case and as such I think the panel got pressured into going with that. It was a special case because of the way the appeal process works is that he could play the game before his appeal hearing. Most cases don't work that way.

Take Michael Turner's red card appeal December 2009, it wasn't a case of him trying to play 1 more game and IMO they had a good case to appeal but, the panel decided Sunderland were idiots and their case was a waste of their time, so they added 1 more match ban.

Frivolous appeal is appealing without reason, making absurd cases and wasting the ever so busy panel's time (how dare teams/people do that). Whatever guidelines they use to make that determination is so arbitrary that it really undermines the disciplinary process on top of everything else.

We just need some kids who can lip read to tell the media they are offended by every sentence uttered by the players when they miss a chance or a goal is scored and we could get half the PL banned.
