Rooney Charged: Faces Two Match Ban for cursing | Appeal lost

Can a club take the FA to a civil court or abritray panel over something the club deems frivilous or unwarranted or unjust?

Or let's say the club appeal and the FA cite frivilous appeal and add another match. Can the club file a case trhough a separate court system?
 
Swear at a camera and hurt its feelings = 2 match ban.

Sexually assault a camera by kissing without consent = nothing.

FIFA forbid the use of regular courts, it would be a very dangerous road to go down. I believe the highest authority we could go to would be the Court of Arbitration for Sport, although that's very unlikely over a 2 game ban.
 
Sooner or later someone will do it. The situation where an FA can do whatever it wants, whenever it wants, however it wants, without explanation, will have to change. FIFA have certainly sunk their teeth in it, though, striking fears of banning countries from international football and such. That's how dirty FA's continue to operate all over the world and no one can tough them.

Ref doesn't see (potential (feck off)) red card incident. FA asks ref. Ref lies and says he would've sent him off had he seen it, which carries a 2 game ban. Hands tied all round.

It'd almost open up a bigger can of worms if the appeal was successful - FA overturning the referees decision...

They've done that before though for England Captain, Big Man, England's Lion John Terry. He got a straight red for a tackle and it was reviewed. The FA deemed it not a foul and an erroneous sending off. Despite the fact that it was a clear foul and at least a yellow. With the ref claiming he'd have sent him off(he wouldn't), it might be hard to change though.

Yeah when was the last time they overturned a ref's decision for United, even though the decision was blatantly and ridiculously stupid?

Good point. But it would require the FA overturning it :(.

Also, the FA would be overturning a ref's decision from AFTER the game, which is basically telling us that the ref is a joke. I can't see it happening.
 
how long to go before the club have to give a response as to whether to deny or accept the charge and also to decide if they want to contest the 2-match ban punishnment?

No news yet on whether or not Rooney will appeal. To be fair, he/United don't have to make public their decision, either.
 
We need to accept the charge. IfLee Mason saying he would have given a red card if he saw it then the appeal would definitely be deemed as a frivolous appeal.

However, we should do accompanied with a statement such as:

-- "We acknowledge that Rooney has broken the rules regarding using foul and abusive language and as such the accept the charge and punishment That being said - we will be compiling a list of players that can be visibly seen using foul/abusive language on the pitch or remonstrating with abusive gestures and will be asking the FA why they have not taken any action in the past. If that this incident is the precedent that is set for all future cases then we look forward to how in the future the FA will apply the charges to all players equally and not only towards Manchester United players and not just when the media tell them the rules need to be applied.

The rules no make differentiation on if the foul and abusive language is said directly into the camera or directed at 1000s of fans, many of them who are children and the camera happens to catch them, so it is upon the FA to treat each incident consistently per the rules they have set forth and not just enforce them when convenient." ---

We aren't going to win this case against Rooney but, we certain can certainly put pressure on them to stop bowing down to the media every time they decide to go crucify a United player / manager in the press.
