Na because there is no doubt that if it is overturned, it will be based on the illegality of the hacked emails (although CAS have admitted evidence obtained through hacking previously). The hacked emails definitely show that City is guilty, the appeal is based on if they can be punished for that however.

Ah ok, so basically I'm right when I'm right but I dont have to admit when wrong, but people who said city were innocent are wrong when they are right and should admit when wrong.

Seems fair.
 
Why didn’t they fight in 2019 when documents showed UEFA conspired with PSG to let them get away with their inflated sponsorships? The same investigator who led that dubious process led the one against City.

Say what you want about the rules, but these rules are the ones agreed upon. If City goes clear they have absolutely no bearing for the future. I reckon this might be a catalyst for a Super League in the not so distant future.
 
Cheeseman is as City as it gets. Biased in the extreme but also well connected.

He can be as well connected as he'd like, there's no one in CAS that's leaking rulings ahead of time. These people that sits in arbitration are highly accomplished lawyers and professors of law that do not speak to the press. They are what you might call heavyweights in their profession and live and die by their reputation as incorruptable. The clubs lawyers and personell sure might "Feel" as if they have made a good case and expect a win, but the CAS arbitrators do not give verdicts to people ahead of time. They know when we know.

Manchester City already took this case to CAS in 2019 prematurely, trying to have the investigation stopped by the UEFA over the allegations of leaks. The CAS summarily dismissed the appeal and threw them back to the Adjudicatory Chamber of UEFA, who in turn rendered a verdict finding MCFC guilty in breach of FFP and summarily banned from competition.

In essence, MCFC tried to have the investigation stopped before they could render a verdict. Fortunately, CAS is not a go to appealate court, they are the highest judicial court fo sports, the final hurdle, not the first.

In fact, this took a bit of a ugly turn when MCFC outright accused the UFA invetigators of leaking to the press. This is an email that the chief investigator of UEFA CFCB sent to MCFC regariding an email sent to them:

“I must vehemently reject your allegations of unlawful activities, either by
myself or by any of the members of the UEFA CFCB, in particular of its
Investigatory Chamber (IC).

Your allegations are groundless in the merits and unacceptable in tone.

Please be advised that I will not continue such an exchange of
correspondence and that I will not respond further to groundless
accusations directed against me personally and/or against my fellow

members of the IC.

I can assure you that at no time, myself or any of my fellow members of the
IC have violated any rights of your club. As you are well aware, all
procedural rights of your club have been respected and all requests, insofar
as justified and relevant, have been granted. The proceedings before the IC
were conducted in good faith and in an independent, objective and fair
manner, as you know well.

Moreover, I confirm that there is no intention to publish the [Referral
Decision] in whole or in part. I refer to Article 14 of the [CFCB Procedural
Rules] which does not foresee the publication of a decision of the
[Investigatory Chamber] to refer the case to the [Adjudicatory Chamber].

I also note that you continue to comment on issues that fall within the scope
of the Referral Decision, which was rendered by the IC on 15 May 2019.
You will be aware that these matters are now before the [Adjudicatory
Chamber]. Your club will have all rights to defend itself before that
chamber, in accordance with the applicable UEFA rules and I am not in a
position to comment on such matters further.

For all issues that do not fall within the scope of the Referral Decision, and
as far as these issues remain pending before the IC, I can again assure you
that your club will be granted all the rights to defend its position. Insofar
as this will be necessary and requested, you club will again be heard
accordingly by the IC, in compliance with the applicable UEFA rules.
Your club will be informed, in due course and in line with the applicable
rules, of any further procedural steps that may be taken in this respect.”

They just can’t believe and will play the “aggrieved and singled out” response afterwards.
 
I think if it is overturned, it may well be the straw that breaks the camel's back where the historically big clubs are concerned.
 
Say it is true and City avoid the ban. How would you feel ? Happy ? Relieved ?

How would they be anything but happy? Basically confirms they can continue to cheat and pay no consequences for it. Gives them carte blanche to break the rules and they will get even worse with it now they know there’s no recourse for their actions.

If the punishment is dropped because evidence was not procured in a correct way, that's not "not guilty". It's "a crook got away with it".

The word being used is exonerated. That's not guilty (IF true...)

So why does this apply now but not last year when UEFA did not even bother to mount a defence at CAS against PSG? When UEFA ignored their own chosen independent assessor about PSG’s sponsorship and sided with the club’s own chosen “independent” assessor instead?

I don’t know. But this will surely fire up the traditional big clubs. Expect moves from Spain and Germany on the super league days after if City go clear.

They’ll get off with a big fine. I’d be genuinely flabbergasted if the ban isn’t overturned. Money talks. City are corrupt, but so are UEFA. They’ll come to a truce of a big fine. Maybe £10m or so.

Who gives a shit anyway? Leicester City, that’s who.
 
Let's wait and see first. If true though scrap FFP alltogether. If the biggest plastics in the game get away with it there is absolutely no use for it.

Agreed, this needs to be repeated over and over again.
 
If this was to be overturned then what is the point in FFP? Surely it would have to get scrapped as clubs like Man City & PSG will continuously find loopholes around it and knowing fine well that they won’t be majorly punished if they do break it.

Wasn't the public announcement supposed to be today, which was postponed, rather than the CAS announcement? Parties involved could well have been told. Shows City's class if they're leaking whatever the findings.
 
If they do get banned now, it’ll be even better than it was going to be as the news that they’re exonerated will be taken as gospel by tomorrow morning.

If they do get off with it then transparency is needed as to why they’ve got off with it and how they were charged in the first place.

Either way, we should still get 4th, but it is nice to have the gap and cushion that qualification from 5th would bring

nah, they do inform relevant parties of the outcome prior to it being made public so they can prepare statements etc, but its literally a few hours before, not days. City wont have heard anything yet
 
Pep saying they're confident means feck. Haven't they always said this, also before UEFA struck them with the ban? Means nothing. What else should he say?

I'll choose to be pessimistic and just prepare myself for them getting off the hook. Makes it that much sweeter when the ban happens to be upheld :D

Depends... if they are going to announce Monday morning (9:30 uk time) they may decide Friday afternoon is only a few working hours so inform them as getting hold of legal reps etc late on a Sunday or at 5am on a Monday might be tricky
 


Based on this, 8:30 AM is late enough in the working day to be informed properly beforehand. No need to do it a few days prior.

nah it'll be Monday morning, 7am 8am etc Swiss time. City wont know a thing until then and neither will their so called insiders. Theyre all getting carried away (although may turn out to be right). If they get away with it, a precedent is set, any other club from now on with same accusations can just say "well City got away with it"

Pep's always going to say he is confident, they were super confident before their 2 year ban was delivered. He will not have a clue what the outcome is though, at all until Monday morning. There is compelling evidence... i think it was said to be plain as day fraud at the time, so IMo, as always stated, they'll do incredibly well to get away without a one year ban. If you ask me, that's why UEFA slammed a 2 year ban on instantly, 1- because the evidence was absolutely damning; and 2 - because they fully expected the appeal (and a reduction to 1 year). With our transfer ban, we were hit with 2 windows, on appeal to CAS it got reduced to 1 and January we could spend.

Of course my thinking on what happened is that deal was shady as feck. UEFA as complicit as City, the leaks broke and UEFA panicked had to backtrack and investigate more thoroughly.

So I assume you will admit if found innocent that they indeed were and this entire forum (myself included) were plain wrong.

There’s no such thing as being found innocent. Only Not Guilty.
