It might set a precedent that we don't want to set. Might be good in the short term if we pay him off, but then every Bailly, Henderson, and VdB (at the least) will also start overplaying their hand.

Far from Maguire’s biggest fan (and wish him a speedy recovery), but I don’t see too much wrong with what he’s done. Very few players actually play football because they love it that much. It’s a job at the end of the day and he wants to maximise all he’s getting out of it financially
 
He ought to realize that if he signs his next contract in 2 years time, there is zero chance that he gets 100k per week for 3 years. So there really aren't any lost wages, certainly not 7m pounds
 
It may make sense for him in the short run to stay and collect higher wages, but will be at an expense of earning any decent number once he becomes a free agent at the age of 32, that’s if someone is willing to pick him up at all.

A “guaranteed” 100K for 4 years at West Ham (plus some payoff from United) must be a better option than 190k for 2 years at United without any meaningful playing time plus, I don’t know, 50K per week for the remainder of his career playing for a team fighting relegation?

DDG is a potential case study of a free agent struggling to find a club due to high wage demand.

At the end of the day hes under contract and can stay if he wants.. But he needs to realise he wont play, & will prob end up losing his England place for the Euros to a regular player. He seems to value his England role quite alot. If losing that and not playing any football is worth it for the ££, thats down to him.

I'd be surprised if it's the last contract, in fact I would worry about United bench shortening his career.
 
Maguire shouldn't get any kind of pay off. You get paid more when you trade up in sports, you should take less when you trade down. If you fail you accept the financial consequences

All right, this is a bit black and white but the club has a contractual obligation to Maguire. If they want to unilaterally terminate that contract, then Maguire is within his rights to demand payment. The difference between his wage at West Ham and his wage at United equals the amount of his damages and he should be made whole. Having said that, I'm sure there will be a compromise and Maguire will go.
 
f he sees out his contract you'd think he's at risk of only getting an offer from the Championship, should mean his England career done too.

The contract is awarded based on him providing a service, usually in a normal contract there are performance requirements regarding level of service alongside the requirement to provide the service. This doesn't appear to be the same in football related contracts, and is obviously very subjective of course. In the real world there are mechanisms to terminate a normal contract for not providing the service to the level required, if we look at it that way is he providing the service that should be expected from a record signing, and very well remunerated, player? Arguably not.

So whereas you are right in that he can ask to be "made whole", it is very easy to argue that he doesn't deserve to be "made whole", since he ins't performing to a level that should be expected. He is lucky that contracts don't appear to have penalties for general performance related issues. So are the club though in reality, since if a player blows up the club could get multiple seasons at a cheaper rate than normal.

He is playing chicken with United. He has to be pretty stupid to think that sitting on the bench at this critical juncture of his career is a good move.

If he runs out his contract, he will land up being like Lingard, training at some former club in the summer and looking for a new contract.

He’s an employee given a contract by the club for extremely high wages. He’s about to sign one last contract which promises him lower wages. Why shouldn’t he seek a payout from the club? If your current employers wants to get rid of you, would any of the forum members happily leave their jobs without negotiating a decent severance?

Before raining the abuses, we should see him as a human being who’s asking for what he’s genuinely due. If as a professional, he decides to earn his bucks here than play at West Ham and strengthen his England case, the only reason he’s able to do that is because of our own incompetence.

Ultimately, I’m quite sure that a compromise will be reached and he’ll be off to West Ham. They can bluff all they want but they aren’t moving on to anyone else.
