In theory, if for example PSG want to sign Mourinho for next season, Chelsea could demand a transfer fee to let him join them. I doubt that'll happen if Chelsea wants him to leave now, but there'll be a mutual agreement unless Mourinho takes a 4 year vacation from football.

Because its Chelsea are the ones that are unilaterally breaking the contract, they are the ones in breach. Jose has no incentive to agree to a low settlement, and neither does Mendez. Thus Chelsea have to offer him a reasonable sum. He cant sit on his arse for 4 years either , so there's that.
From those two different positions, they'll need to reach an agreement. That Jose has a strong bargaining position means that the amount will be higher than what AvB got for example. I can see him getting a 20 plus mil settlement.

Clubs don't fire managers in the sense of tearing up the contract and dealing with the consequences later. They suspend managers and negotiate the contract termination unless there are clauses in the contract.
