I imagine it is public because Cardiff have leaked it - and not because Nantes have.
I was wondering when this would happen. A really horrible situation that has just got worse.
Cardiff should have just proceeded with payment and not failed to pay because the player never played a game for them.

To be honest they've lost their best player, a guy that scored most their goals. £15m is a lot of money to a club like Nantes, so they desperately need that to get somebody to replace Sala.

It's not their fault this accident happened. Cardiff should be respecful and follow through with their deal.
 
Whichever club leaked the story should be a ashamed of themselves as the body has yet to be recovered nor a funeral held. Respect the player and his family before all this should come out. Cardiff have already said they'll honour the contract so it's a weird thing to leak.

Either or, it's poor taste. Deal with it privately. It's a shame that the moral and ethic implications of this situation have been dampened a little by this as above all recently in football both teams and individuals who are involved in horrible situations like this have been completely respectful. Neither family has had any closure so i'm a bit disappointed by this.

Of course the money will need to be paid as contracts need to be upheld despite the situation unfortunately, but keep it to behind closed doors.

Yeah “we’ll honour the contract” sounds like they could well be checking to ensure that the contract is valid first - i.e. all paperwork have done to finalize the transfer.

Bit of a cnutish move for Cardiff not to pay, while now pointing at Nantes, and saying they need to be satisfied with the documentation blah blah. The transfer was completed. If Nantes do this, it's because Cardiff failed the first payment at a certain deadline.

So, Nantes realizes Cardiff is delaying, implying Cardiff's lawyers are investigating in the small print and the law if there's any way to get out of this and feck Nantes.
 
It’s a bit of a touchy situation. A life has been lost and that is tragic but I wouldn’t expect Nantes to write off £15m out of some level of moral obligation. A fee was agreed and I’m sure some level of documentation was signed and he died in a plane I assume was provided by Cardiff. It’s sad but business is business. Worse is how this news has got out at this point.
 
Cardiff just need to do the first payment. It's tragic, they signed him, he died in a tragic accident. At least man up to the financial loss.

My money is on the insurance company being dicks. Cardiff essentially saying Nantes will get paid either way but who will pay ain't resolved.
 
I assume clubs have insurance covering something like this?
 
It's all a bit crass but I can't really say I'm surprised this has happened. The Cardiff 'source' who made this information public is a bit of a twat in all honesty.
 
Surely contacts were either signed or not. If they were signed Cardiff needs to pay. However, one would hope whichever side is liable is insured.

As posted above, the fact that it is leaked by anyone, is cnutish and inappropriate. Cardiff are most likely trying to figure out if they will be covered by insurance and trying to proceed with that prior to paying instalments themselves which is fair enough, i don't think they will be trying to 'feck Nantes' at all ffs.

Such as insurance wouldn't pay Nantes, it would pay Cardiff for the financial loss. In other words, that's Cardiff's business, and not a reason to delay payment.

With the article saying 'BBC Wales has learned', my assumption is someone at Cardiff leaked it to try and make Nantes look like insensitive dicks in the court of public opinion as well as try to delay things further.

I don't think Cardiff are trying to get out of paying completely, but they will be trying to deal with the insurance company and they will probably be dragging their heels due to there not being a body recovered yet as well as the issues over the plane and the legality of traveling on it.

It could well be a reason to delay payment. We do not know the terms of the contracts or insurance policies. How are we to know that if Cardiff pay through their own finances that they will then not be reimbursed by insurance? These contracts are complicated at the best of times and this is the first time a situation such as this has happened so the legalities etc. are something which will most likely need time to comprehend and figure out.

I doubt that because normally it's the value of the asset that's insured, not the transfer sum. You buy a TV with 3 payments. You get the TV. It gets stolen the next day. You don't make the first payment. There is however no relationship between your insurance and the seller. If the TV was worth 1000, you have to bargain with the insurance company to get your asset refunded. It doesn't matter if you bought it yesterday or after your last payment (except in the asset's value at the time).

I doubt an insurance company will pay out on a new policy (for I am assuming £15 million) when he is still just listed as missing.
 
While it's difficult to say precisely what is happening, any delay in payment could be down to Cardiff's insurance underwriters. If their underwriter is not satisfied with the contract they will not payout, therefore need to undertake their due diligence which simply takes time. In all probability it will not be an issue, however if the underwriter identifies any gaps in the contract then Cardiff or Nantes could be liable.

With that said, the leak of the story is inappropriate and should not have happened while recovery and funerals are still to take place.

Why would they insure the buying price though? If I took out insurances on employee's lives it would be on their contribution towards the company, not the compensation I paid to a previous employer to free him of previous obligations?

Invariably the insurance taken out on a player will, at the very least, cover the entire cost of paying up his contract along with any associated costs. If there are no explicit provisions in the contract as to what the club would have to pay the player in the event of their retirement, that’ll usually be the entire base salary payable under the term of the contract, less certain elements for taxation purposes.

I'll be honest, and apologies in advance for the crass thought, but when it happened, this was among the first things I thought about though I suspected it would be Cardiff kicking and screaming and asking for a refund

Apparently he was only insure up to 16 mil. When you fact in his wage over the length of his contract the total cost to the club is closer to 25 mil. Also Bordeaux have a sell on clause in the contract so theyll be wanting money too. Its all very fecked up, I can see the point of view from both sides. One side paid for something they didnt get, and the other sold something that its not their fault was lost. It just a shame that the thing in question is a human being with a family that must be going out of their minds and none of this twatery about money will be helping. Both clubs needed to take care of this behind closed doors. Nantes should have had a conversation, not sent a demanding email. And cardiff should have reached out to explain the reasons why the payment was being held. Waiting to get all the facts isnt an unreasonable request. They both should have done more to keep this from being a public shit show considering the unique nature of the tragic event.
 
I've read someone in reddit claiming they have worked in insurance and that these types of large contracts sometimes take a bit of time to sort out. I wouldn't be so sure Cardiff already had the player insured, it may well have been one of those things to take care of in a few days.
 
This was one of the first things I mentioned. I feel the fair and respectable thing would be they split the money. Because on one end Cardiff did not get the player they signed and if Nantes don’t get the money they lose the 15M and there best player. I feel splitting the money is the fair thing.
