Is there much precedent as to what the outcome could be? Going rate of similar deals, fraction of remaining contract value etc?
 
I think we are interested in Freedman, because there has been noise about it before.
But if we weren’t, it would be quite smart to brief a few journalists that we were and then float the idea to Newcastle that we’ll back off if they’re willing to be a bit more reasonable regarding Ashworth.
Would we feck, Freedman would be the ideal and standout choice for Head of Recruitment.

The highest ever-paid fee for a Manager, is 15 million, Poter to Chelsea. These jokkers are asking for 20m for an exec, and are wondering if the fee is reasonable. Jesus Christ. Do take them to court, and fecking skint them. Pay them as little as possible, while ruining their public image. Good luck hiring new people knowing how much of a bitter cnuts they can be when a better opportunity presents itself for their employees.
 
Directors of football are a bit like buses aren't they? You spend ages waiting for one, and then a pensioner takes you to a depot where you somehow steal three at once.

Not a lawyer or much of an expert but I think the valuation placed by Newcastle on his contract is madness and reeks of spite. Then also comes the issue of Ashworth being reportedly sidelined by Howe and his nephew on first team recruitment.

So we have unreasonable demands to break contract whilst not ruining his career prospects and a set of working conditions where he didn't have the freedom to contribute meaningfully hence him looking for opportunities elsewhere to further his career.
 
I did suspect this might go to a tribunal. The compensation and notice period suggestions both seemed excessive.

I'm glad we've stuck to our guns instead of being bullied into paying a stupid fee yet again. Teams see us coming and it will continue to happen until we take a harder stance as we have here.
 
Third party arbitration is surely better for us. Based on Newcastle’s insane asking price for it, an unbiased party will see that as unreasonable and excessive and it’ll be whittled down to a certainly more sane figure, maybe even a figure that heavily favours INEOS.
 
Correct me if I’m wrong but arbitration is not court and Newcastle can just refuse going into talks. If this happen then Ashworth can take it to the tribunal (court) which is a lengthy process.
 
Berrada is on gardening leave until June right? Can't they both just sit down and chat about their future and strategy while not being employed at United?
I suppose it might be to do with contacts, if we suddenly start contacting players/staff through known contacts of Ashworth/Berrada while they're on gardening leave, we'll probably be looking at a big court case.
 
Ashworths first real test. If he can weasel his way out of Newcastle using a tribunal I think that holds him in good stead when negotiating incoming player deals/contracts

That would be a good outcome for us.
 


Arbitration will say 6 months max I reckon. It makes no sense to restrict him working for nearly two years and that’s what they’ll say too I believe, it’s technically restriction of trade if it’s not a reasonable restriction. He’s already served 2 months it so I reckon they’ll come to an agreement before.

Newcastle fans version of "winning" ignores the fact their marquee hire is being paid not to do the job they paid Brighton millions for him to do, because he wants to move to United.

There is no scenario in which they win here.
 
Whatever decision an independent arbitrator comes to is binding. I wonder if he had an arbitration clause in his contract or if the parties voluntarily agreed to it. Either way Eddie Howe saying that they’re coping fine without him and that it’s not effecting them much has actually done a lot of damage for Newcastle in this process, the fecking idiot. :lol: :lol:
 
There was a report that Fergie actually made the recommendation to hire him as DOF a while back, I think it was in a ‘tell all’ piece from the Athletic.

It wasn't a ridiculous take. When somebody is an addict (gambling, drinking, drugs - mostly the same) it's almost impossible for them to hide it from their inner circle. And once couple people know, their girlfriends know, cousins know etc. etc. - word spreads. You lot seem to think Tonali is some kind of mastermind of conspiracy, I doubt he is. So people knew and once people knew, once there were rumors, it's not just betting companies spilling to police that you can find these kinds of things out from.

Anyway, like I said - I am sorry I questioned the almighty Ashworth. He is the most amazing thing since sliced bread. I am going to just sit and wait when he transforms us into second coming of Man City.

Tonali was the Serie A poster boy. He was a mix of Gattuso and Pirlo who always acted the right way on the pitch and always said the right things off it. Tonali is not the only player who was caught with his hands in the cookie jar. Fagioli and Zaniolo were caught too. I refuse to believe that their clubs didn't know. Zaniolo was sold for a pittance to Galatasaray and Tonali's move to Newcastle was a surprise. However these things can be kept under wraps up until the police steps in. We've seen that with Toney, Trippier, Sturridge and Townsend. You can't expect a sporting director to be able to scrutinize players the same way as the police could do.

Bruno Gimaraes has a 100 mil release clause. I would get him this summer so that the meltdown reaches epic proportions.
 
Newcastle trying to make some sort of power play, whilst Ashworth just advises us from home and Newcastle picks up the bill.
