That's debatable. He got behind the wheel in an intoxicated state and drove recklessly. This shows very little regard for the safety of his passenger. Moreso since he was in a position where he could have paid for alternative transportation.
The absence of malice doesn't mitigate his actions very much. Legally yes and the sentencing reflects that but from a moral standpoint the callousness very nearly equals premeditated harm.
