That's debatable. He got behind the wheel in an intoxicated state and drove recklessly. This shows very little regard for the safety of his passenger. Moreso since he was in a position where he could have paid for alternative transportation.
The absence of malice doesn't mitigate his actions very much. Legally yes and the sentencing reflects that but from a moral standpoint the callousness very nearly equals premeditated harm.

Exactly, he is rich enough to not even care about paying for a taxi of any nature and he drove way above the speed limit, so he wasn't the sort of drink driver who was being overly careful knowing they are compromised. He simply didn't care.
