Sounds like if the Aussie government is serious about deporting him then it’s an easy win. Although I’ll admit there’s an excellent chance this is saber rattling to appeal to their base and they’ll back down at the last minute.

I think the option to back down has gone. In the unlikely event this cancellation fails they can still cancel again based on him lying on his entry form. And they will probably go there as they have tied this (somewhat oddly) to their hardcore mistreatment of mainly brown refugees, that appeals to their base.
 
Djokovic is that kid who hangs around the cool gang and when they ask him to leave he says "I can stand where I want" and when they move, he follows. No-one in Australia wants him.

The really galling thing is that this is just sport, he's not trying to stay because he has sick family or is poor and depserately needs to work. He wants to stay to earn money he doesn't need for a title he doesn't need. He's doing all this for nothing more than personal glory, it has zero value to the world.
 
Why does it seem to be Djokovics legal team that is in the driving seat and determining timelines of when this and that should happen?

Surely that's a determination for the court and no one else?

Im sure they do have other cases to hear after all and then have a bit more to do than just jump to the demands of one arrogant tennis player after all.
 
Djokovic is quite the prick. I hope he has this same disbelief in law and rules when someone breaks into his house and nicks all his stuff.

Depends. I think he’s more likely to be deported that not but there are a few things here that don’t necessarily come through in that thread.
1. Ministerial discretion is never unfettered in these cases, despite it being framed that way at times;
2. Matters heard in front of the same judge, statistically, tend to disproportionately fail (by that I mean the general % of times a judge diverts from their original finding is lower than when matters are heard/appealed before a new judge);
3. Djokovic’s lawyers will be much better than anything the state have;
 
The funniest outcome here is that Djokovic is allowed to stay, gets to the final and then catches Covid right beforehand, meaning he’s shown up for having lied about just having had Covid, can’t play and this has all been for nothing. For sheer lols it’d be hard to beat.
 
I hope the judges, linesmen and lineswomen consistently call his shots out whenever it looks dubious. Give him no free points.

Regarding the bolded, the original decision was only only on the process used to refuse a visa rather than whether he was allowed one or not. I don't think that will have any impact on this case as the decision is now purely whether he is allowed in Australia rather than technicalities.
 


Is it possible that if the case is not decided on Sunday, he'll still be in detention while it's being decided and thus misses his match?

It'll be interesting to see how Murray copes. He'll have an extra days rest than his opponent here, but it could hinder him at the AO with the 1st round being so soon after this is done.

Ooops, I got it wrong, guys! That match on Eurosport is the Adelaide International. The Sydney final seems like it's on Amazon Prime, but I don't know what time at...

Unfortunately, that would just make him one of many who caught the delta variant in December and omicron a month later.

Most of those will be refugee applications. Your average visa cancellation goes home on the next flight.

I am not a legal oriented person, but I believe it's not the defence's job to refute "a feeling". The burden of proof should be on the prosecution . Not sure if this is the correct term either, since it's not a criminal case.

They don't have to prove it as it is a ministerial order. I think Djokovic has to find reasons for it not to happen and that is a fairly high bar when trying to contest a Ministerial order.

Even if successful Djokovic could have his visa cancelled again for lying on his entry form.
