Just for example, take former fitness coach Tony Strudwick at United. His role was changed this time last year when we brought in Jos Van Dijk to carry out the bulk of his work. His role was changed and he was titled head of athletic development instead.

If he felt to have been "demoted," as you put it, and decided to leave the club in similar circumstances to that of Carneiro, would he too have a right to sue for constructive dismissal?

I'm genuinely curious, like I said.

I don't honestly care and if she looked like Susan Boyle, this would be a non issue for many. The fact is there is a lot of sexual tension here and until she does a sex tape, things will never be the same again. The Drs on the bench now not only have to be qualified professionals, but they have to be sex addicts and look good in the nude.

That's what this is. It's nothing to do with her qualifications of the fact it's a woman. It's the fact, the people are horny and I can't say I blame them.

Fair points. So these kind of cases are generally heavily circumstantial, I assume? This could get quite ugly provided Chelsea don't try and settle this away from the courts, which I assume they'll rush to try and do.
 
She may have a cause of action under the 2010 Equality Act which covers everything from bullying, harassment, and constructive dismissal.

But its a lot weaker because Jon Fearn is still there. Its the media and the twitter goblins that blow the who thing up. I am sure she got a nice severance pay, but as for suing, i dont think it will hold.

The club made her position untenable while she hadn't done anything wrong. They publicly demoted her. Even if it was private, it wouldn't matter. She has more than enough reasons to sue. There have been many reports that club officials are uneasy about the situation but any effort to support her or apologise undermine Mourinho.

She's only talked about, cause she's a woman. Would it be a man, no one would even know his name.
 
It's constructive dismissal clear as day. Demoted for doing her job as per the guidelines. She'll settle out of court for a large sum. It's not as if she pissed off the entire club, she was apparently well liked. It's just Jose being Jose.
I'd say Roman will happily pay her off to make this go away and as a sort of apology.
 
I would say she has been well paid off by Roman already on the condition she keeps quiet... didn't the same happen with Wilkins some time ago. He kept very quiet.
 
Yeah, I was gonna say: I think Chelsea already have an established laundry service. Mourinho himself is well acquainted with the hampers, after all.

This would not have happened if Hazard went down like a baby. Maybe Jose should have asked him why he went down rather than screaming at the physio.

In today's climate, I wouldn't be too certain of that and Fearn is a male. But I imagine that a fat cheque with Roman's signature on the bottom will soothe any hurt feelings. I suppose she still wants to work in professional sports and being seen as a litigious person might scare of potential employers. Despite it being 2015, the patriarchy is alive and well, though somewhat below the parapet.

Now seems like the ideal time to continue investing in our medical department. There's a top class doctor with a wealth of experience and knowledge in sports science up for grabs, and she knows Chelsea inside out. It's a no brainer for me.

If 2 people are mistreated in the workplace, it doesn't make it ok because one of them puts up with it. At the end of the day, they were publicly and harshly criticised for doing precisely their job, then effectively demoted or at the very least had their job scope restricted.

She has a solid case for constructive dismissal and just because a colleague who also has the same grounds chooses not to act on them, does not alter her case.
 
So she gets demoted for doing her job, the doctors first duty of care is the patient not the football club. Mourinho is a pr1ck and if he had genuine friends they would have told him he was in the wrong and that he should sort it out and apologise. A bit like when Ferguson's wife told him he was wrong to have a go at Rio.

I hope she sues the club and wins, if something had been really wrong with Hazard and the doctors had not performed their duties everybody would be having a go at the doctors even the stupid tw@t Mourinho. Hazard is also a f**king pr1ck for faking an injury, his actions have now caused from what's been said a well liked member of staff to leave, as well as his manager and club problems. What an utter tw@t Mourinho and Hazard are.

I still dont understand why this is such a big deal..... If it was a bloke barely anything would be made out of it. The fact that it's a girl and she's quite good looking is blowing this all out of proportion. Wasn't their a male trainer as well involved in all of this?
 
I said at the time they were risking her taking them for constructive dismissal, and that's exactly what it seems she is going to do.

They will of course pay her off before it gets to court as they have behaved disgracefully and are 100% guilty.
 
It'll be interesting if anything actually does come of this legally. If it does, Mourinho better hope that they are playing brilliantly at the time as he will be blamed (rightly) and will come under pressure. The only (semi-) rational excuse offered for Mourinho was that we may not know what exactly was going on behind the scenes. If there was something up, I'd imagine we'll hear soon. If not, we can assume that Mourinho was just being Mourinho.

This became bigger news because of how the tablod press handled it. There was that utterly vile and despicable article about her sex life which magnified the situation. If the male physio had ended up with some vile despicable article about his sex life in a newspaper, his story would have stayed in the news.
Saying its because she is a woman ignores the whole story.

I'm not saying its not news-worthy, but its been glorified and sex-ified because she's an attractive woman. There would never have been an article printed about the male physio's sex life in the first place. And had Carneiro not been part of the incident with Mourinho this whole story would never have been anything more than small-print.

Sorry I disagree, if the male physio had been gay ( only use the gay bit because it would be more titillating for the gutter press) and a jilted ex lover decided to go to the press they would have jumped all over it. The story would have taken a similar path.
 
It will be settled out of court i would imagine should anything of legal consequence happen, Roman will likely just pay up and keep things as quiet as possible.

A jilted ex-lover would never have gone to the press because it wouldn't have been given such heightened press coverage in the first place. It would have been seen as just another argument between two team members.

Because she wasn't a story before the incident, but all of a sudden she is. Why didn't her ex-lover go to the press before she was involved in the incident with Mourinho in that case then? Attractive female becomes news story, press jump all over it, ex-lovers come out of the woodwork. If Carneiro wasn't a woman, this would hardly be a story covered by the press. Many, many physios have been fired from their clubs in far worse circumstances than this, but chances are we've never heard about it.

People finding mourinho shouting at a woman distasteful made her position untenable.
It'd have been a total sideshow, clusterfeck for the season if she came back (which i doubt she has any real appetite for, who would?)

And people want her here because?
We'd have to replace or fire our current team doctor to get her in just to ride the 'we have a woman working for us, aren't we great' gravy train to its embarrassing end,
which i find far more distasteful than a boss being a dick to someone

Because numbers are showing that she is arguably the best in the business even after she saw 4 Chelsea managers come in and out with different training methods. With all due respect to Steve McNally, I just can't put him at the same level as her when you look at their respective resumes.

And besides, didn't Tony Strudwick get moved to a different (and arguably higher) position after Van Gaal arrived? Van Gaal can always find something for McNally if United somehow get someone as highly rated as Eva Carneiro.

Like people already said, Mourinho is a cnut and Chelsea are a scum club for the way they acted towards their own staff.

I always bring this up but, just last season Pep's falling out with Bayern's medical staff became a big story in Germany even though none of them were female.
