Donald Trump - GUILTY!

Part of me thinks that the only reason why Pence is doing this is because he is well aware the history books won't be kind to everything Trump and he's simply trying to save his legacy. Not so much because he truly a standup guy all the sudden.
I don’t really care why he’s doing it. The evidence he’s given to the indictment (like in my post above) and his subsequent live testimony could be monumental.
 
And then he says that the key part of these laws, they revolve around a person's intent and tend to score to the notion of fraud, only if someone is knowingly trying to deceive others can he be committing a fraud. And he says that's why the case seems likely to revolve around Trump's state of mind. So the problem with this is they have to not only prove that what Trump did in the wake of the election was indefensible and outrageous etc, but they have to prove that Trump knew that he lost the election and knowingly perpetrated the fraud. And I don't think you'll be able to ever prove that beyond a reasonable doubt. In his mind, Trump won – and he had all his bootlickers like Giuliani, Sidney Powell, the Pillow guy telling him he won and he should sue – so it’ll be tough for this prosecution to prove their case beyond a reasonable doubt.

In a January 2021 phone call between the pair, Trump “berated” Pence for saying there was no constitutional basis for the vice president to reject electoral votes during the certification of results, according to the indictment.

I like how Pence suddenly has grown a pair, we all knew he was a weasel on whatever side is doing the best but even for him this takes the piss, only doing this now because he's (unsuccessfully) running for President, give that weirdo from Utah a run for his money at least.

Unfortunately for Trump, he can actually do whatever he wants, I see they are turning the screw but until someone stops warning him and actually reigns him in, he'll continue

The documents case is legally solid, although others like Berger, Petraeus, and Clinton violated classified requirements without prosecution. Sandy Berger - Clinton's National Security Advisor - stuffed his pants with classified documents from one of those clean rooms and got away with the slap on the wrist. Prosecuting Trump feels challenging, given past leniency for similar cases.
So the arguments seem to be:
Other people have mishandled / taken classified documents in the past, and not this much has been made of it. Indeed, both Pence and Biden have recently been 'caught' in posession of things they shouldn't have. But here's the rub, everyone else, when notified, gave them back. What they did not do was have their lawyers lie about giving docs back, deliberately moving docs ahead of the FBI coming to get them, potentially asking an aide to flood a pool to destroy evidence and oh yeah get caught on tape showing military secrets to a random group of fans. Otherwise same thing.

2. Trumps actions in inciting the Jan 6 riots are unprecedented, and on untouched legal grounding, so maybe we shouldn't bother cause it's hard. Hell of a legal mind you've got there.

3. We can never truly know the inside of another human beings mind, and this crime (like a huge number of them) require that. So again, let's not bother. Nevermind you literally have Trump talking about the 'other guys' problems' on issues he didn't want to deal with which Biden would have to when President, or the countless witnesses acknowleding he knew he'd loss. Again, this is very common in the US legal system. I agree, it's not a slam dunk, but it's also not some crazy theory.

Finally, Georgia is the one. On tape, asking for votes to be found from a person in position to find them. I can't remember the wording, but it's almost a text book example of breaking that law, and simply asking is a crime.

He's an awful human being, a terrible criminal and keeps doing crimes (did another one today, huzzah!) therefore he should be tried and found guitly as a criminal.

Guess it depends on how the rules are set, presumably there's no actual law, either way you know Trump will decry which ever option is selected

Thats what feeling untouchable feels like. He has been always like this. All his life passing through his bone spurs to 6 times being bailed out from bankrupcy till he became a nominee "grab them by the pussy" and i cant shot someone in 5th ave in broad day like. Almost 80 years of untouchability. Why he should change now? He feels he will get away. And anyway, he doesnt have that much time to live. Only 30 years more the fecking bastard. They never die

Dying on the hill that Donald fecking Trump is being wrongfully prosecuted is probably the most stupid political take I've ever read on the Caf, and just a few days ago we had a user post that Nigel Farage was completely correct on all counts (almost verbatim). Donald fecking Trump no less, the worst person and the most dangerous personality in the world for the last decade at the very least.
