Doesn’t really make much sense what Newcastle are doing for a sporting director in practice. Surely he can just tell someone in conversation who tells someone who tells someone that United should buy X player on gardening leave? How can you stop that?
They can afford to keep him on the payroll if they are fuming about this. I'm curious about a gardening leave situation though, how strictly that is normally adhered to. If he was seriously appointed and not in situ before 20 months, I would assume they are circumventing that gardening leave in all but official capacity.

There wasn't much of connection between Ashworth and Howe at Newcastle and it seems the player Ashworth brought to the club from Chelsea (Lewis Hall) for £34m isn't wanted by the manager. We reached a settlement figure to effectively tear up his contract and waive our non-compete clause.
I think they'll relent eventually because Howe seems to be in charge of things at the club. I think they might accept a compensation figure similar to what they paid to Brighton. Of course not. That would be a Woodward-esque move and quite contrary to what Omar has said previously (in what is required to be taken seriously as a club).
Contract law. If found to be acting directly or indirectly on behalf of another party contrary to his current employer’s interests, while under contract to an existing employer, he would leave both himself and conspirator (in this case his prospective new employer) wide open to a lawsuit.
For example, if while under a “non-compete” contracted status he were to share transfer targets, confidential or legally protected information about his employer, methods or business operations he would be in direct breach of employment contract law.
If you’re asking how a situation like this would play out specifically it’s largely uncharted waters as these things are always sorted with private settlements behind closed doors.
When it doesn’t, it gets very messy and very, very expensive. A non-sport related example would be Michael Eisner, formerly of Disney. He left Paramount Studios to become CEO of Disney. While under a “no direct competition” clause, he leaked plans about the Universal Studios theme park, which Disney plagiarised wholesale to make their own version called Disney MGM Studios. He also shared with Disney several upcoming Paramount films in pre-production, which Disney were alleged to have then plagiarised.
The whole matter was eventually settled out of court, for an estimated $600m plus legal expenses of at least the same.
What will happen in this case is the lawyers for all three parties will thrash out a deal over the coming months behind closed doors and he will join once the compensation figure is acceptable
I think Newcastle will hold out until September 1st and then I'm going to presume he will be allowed to join us. In the meantime I think we should be fine in the transfer window because the players to buy are put forward by heads of recruitment and not the DoF. And with the Glazers hopefully not actively involved, it should correlate to it being a smoother transfer window.

Almost certainly not. His contract will stipulate this. There is no loophole to be found; it will very likely be a case of a long, expensive negotiation between Ashworth’s team and both clubs to find a solution. He’ll sit at home until then.

24 month notice period seems a little excessive, even for a senior exec. I presume it's more like 12 months notice, with additional post-termination restrictive covenants (the latter of which are obviously easier to challenge and less likely to be enforceable). It won't happen anyway - he's already on garden leave and it's in all parties' interests to reach an agreement.
They have a good amount of reports that they have to sell next summer to hit ffp requirements. If they are not exaggerated, they are absolutely under pressure to get compensation for him and not pay his wages.

Ashoworth going from Brighton to Newcastle nobody cares. Going from Newcastle to Utd is a big thing. Plus offering more salary would only hit them on FFP anyway
This is a key point. I don't think this will get messy.
It will be £2m in the end. There’s not a single scenario where a non playing member of staff is worth more than their contract.
