No it doesn't clear it up and I understand the Webster ruling perfectly by the way.

I wouldn't expect somebody with such dreadful comprehension skills such as yourself, ''alot'' is in fact ''a lot'', to have even the remotest grasp of contractual law.

The pay rise wasn't agreed in the original contract Berbatov signed in 2006, therefore any change to the original contract, such as the pay rise, constitutes a new contract being agreed.

As I said above, in the rule, it says it's not when a new contract is agreed, but when a new contract is agreed with an extension of the duration.

I am currently in the Berbatov thread, who is still currently a Spurs player, who is linked to United.

I don't think I've spoken about anything else to do with Spurs besides him?

I just read the rule(I must learn to let things go:)), and you're right. Apologies. The protection period only starts again if the duration of the contract is extended. That makes no legal sense at all, but there you go. That's FIFA for you.

The two year extension option included in the 2007 contract meant that the protection period started again.

Spurs aren't daft, they wouldn't have increased Berbatov's salary without getting anything in return.

It only starts again if they exercised the option. I can't see any evidence that they did, yet. Obviously, if they do, then it will start to run again.
 
Nothing to do with articles or links. You said "I remember clearly"....implying that you remember Spurs information clearly. Not many United fans do that. You must be special.

I am very intelligent, modestly speaking.

Also, you must remember that we were linked with Berbatov at the time, so when we didn't get him, I did ofcourse read the articles relating to Spurs signing him, and also followed his progress to see what we missed out on.

I have 2 Spurs mates aswell by the way.
 
Can we just buy him? If not to calm a few nerves around here who think not winning on the opening day of the season means that next year well will be in the Championship. Level of panicking from some people is unreal!

Alot of people think he only scored one goal outside the box for United, but in actual fact he scored 2.

One came against Charlton in a league match, and the other in a pre-season friendly against Club America, the same game which we remember Diego Forlans incredible miss.

I believe in the second last game of the 02/03 season Ruud curled a shot from the left hand side of the penalty area (outside the box), which almost beat the keeper. It was against Blackburn. Ricardo saved a penalty the same day.

When we played Madrid in the return leg of the Champions League in 2003, he also struck one off the post from outside the box, the same night Ronaldo scored a hat-trick against us, the second last person to do so, as Bentley scored one against us away to Blackburn in our 4-3 defeat in February 2006.

Afonso Alves went close last year, scoring 2 and narrowly missing his third in our away trip to Boro.

Just a few more bits to add there about 'United'.

I'm not denying that. In fact I agree with you. The fact is, and I read the rule a while ago, on a strict ruling it suggests that the protection period only starts again when the contract period is extended. An option to extend is exercisable not exercised. Obviously having the option, all the have to do is exercise it, and he is goosed. Also someone mentioned clubs from the same country can't be involved in a Webster transfer-maybe you(or someone) can clarify if that's the case.

I'll copy the relevant section for you below. I stand to be corrected by others who know more than me about this.

In addition to the obligation to pay compensation, sporting
sanctions shall also be imposed on any player found to be in breach
of contract during the protected period. This sanction shall be a
four-month restriction on playing in offi cial matches. In the case
of aggravating circumstances, the restriction shall last six months.
In all cases, these sporting sanctions shall take effect from the start
of the following season at the new club. Unilateral breach without
just cause or sporting just cause after the protected period shall not
result in sporting sanctions. Disciplinary measures may, however,
be imposed outside the protected period for failure to give notice

I have been told a deal is done, Spurs just have to get a replacement/replacements in first.

Nobody knows how much we are paying.

Just say my friend is wrong, and a deal isn't done. Perhaps because of the Webster Clause coming into force next season for Berbatov is why United are dragging this out to the end? There is a thought, and United won't go above what they have offered because of that so it puts pressure on Spurs to accept what United will see as a very good offer.

United are desperate for a striker however, so who'll swerve first is the question?
 
I'm not sure Article 17 can be used for transfers between two clubs in the same country.

I'm 99% sure it can be, you're essentially buying yourself a free transfer, once you've done it you're a free agent and can sign for whoever you like. You might be thinking of the rule that says when you're 6 months from the end of your contract though, you still can't speak with anyone in your own country.

If United dont get Berbatov this year, which I reckon they will(get him); I certainly think they will go for a different target next year

not entirely correct. now don't get your knickers twisted, but according to glaston, spurs have the unilateral option to extend berbatov's contract a further 2 years if they wish to keep him. if we don't get him this summer, he will go to the continent next summer.

Yes, you are correct there, I have read that it is Spurs option, but with them failing to agree a contract extension in April of this year, why didn't Spurs just go ahead and invoke what they see as their option?

I think there could be red taped involved that we don't know about.

true. then again, i've only heard this from glaston, who im sure heard it from his ITK's, which must always be taken with a grain of salt.

regardless of that, IMO if we don't close the deal in this window, berbs is off to spain or italy next season. just my opinion.

which could work out great, since hopefully benzema will be truly on the market after proving himself in another season of ligue 1.

benzema has and still is my ultimate number 1 choice

i can recall reading article that states that there are a mutual agreement among the clubs (G14 maybe) not to use that ridicules rule to buy a player:smirk:

Because they dont need to yet? Chances are, if they give him a new contract and want him to play well they'll have to up his wages again. Why would they give him such a contract before they need to, near the end of the season? They can save themselves money if they wait, surely.

As for Webster, yes I'm pretty sure it only works with clubs outside the country. If it all went down, Milan or Barcelona would get him cheap. Not us.

I stand corrected.

In that case, we should simply tell him to break his contract and sign for Royal Antwerp on a one day contract.
 
So lets get this Webster thing right then.....

Its OK to sign a contract for 5 years but if the player wants out after three years he can buy himself out. Unless he was over 28 when he signed. But if a contract was modified in any way it then becomes a new contract and the player has another three years before he can buy himself out. Unless he's over 28. Before this can happen though someone has to invoke something. But this can only happen if the player wants to move to another country. For this he must be under 28.

Then..... all this is ignored by the clubs in a G14 agreement. But the players, 28 and under, needn't follow the G14 rule unless they're over 28 in which case they have to invoke something else. Now, if the modification to the contract is only about a pay rise then the contract is not necessarily modified in terms of the buyout (and the 28 year limit if signed at the second contract) and so the player can buy himself out so long as he's under 28. But only to a foreign country.

However, the G14 clubs have agreed not to use the Websters Rulings because 1) they do not understand them and 2) the G14 clubs no longer exist.
Spurs were not a member of the G14 so they can then invoke anything they want, whenever they want. And the player can invoke stuff too, if he wants.
So there we have it.
