No. MU could have easily had Ander at Carrington without any permission from the spanish club. If MU going through the release clause route, that's not a transfer, that is unilateral contract breach from Herrera's side. And 36M is damages payed for the breach of the deal. That's how any release clause is structured in Spain.
So the only question now is can United's lawyers close the deal. As for how and why Athletic "turned down a bid" you can read here. They just probably refused to accept payment.

Look, before we entered into this negotiation we would of known that Bilbao were unlikely to just accept the bid.We would have hired the appropriate lawyers and the research on spanish buyout law.

Whatever sum we have to pay through this method we will be comfortable with, having known so beforehand.It think it is unlikely that we will have ton
pay 50m due to tax anyway.

I know some of you think the club is run by a bunch of idiots that can't get a tranfer through but the reality is a massive club like United will have done its research and be prepared for this situation.

It's way too easy now, but it does lead to more entertaining meltdowns.

Never said it was beneficial. It is beneficial to us not to pay the tax and they know this. They are obviously using this as a way to get more out the deal.
 
I'm not worried, I still fully expect Herrera to sign with us as soon as possible. It seems Athletic Bilbao are cnuts to negotiate with when it comes to transfers.

You wouldn't do everything we have done without examining all the possibilities, especially in a scenario like this one.

before you came back the caf was a ghost town compared to the newbs. The new, more lenient policies may have lowered the standards up here but it's certainly more active.

anyway, is this really any worse than last summer? the same spastics were already here back then.

Woodward was culpable just as much as Moyes last season. Fabregas, Thiago, leaving Herrara and Fellaini till the last day and fecking up Coentraos loan deal hardly left us in a great position did it? It's his job to secure deals for the club. Mata aside he's failed so far.
 
Yes, I'd imagine this bid was actually rejected days ago, and they're only announcing it now to appease fans(that they fought to keep him) as the other path has been taken and they can do nothing about it.

Athletic are a rich club who don't want to sell their best players. They always go to extreme measure to keep their players.
Not just because they are rich. I believe it is because they are a very elitist Basque only club and will only field players of Basque origin. So even if they had a lot of money, finding good players of Basque origin who are willing to join the club is very difficult. Understandably, they are stubborn. I don't blame them. Doing this also appeases the fans, as it shows they are fighting to keep their players.

That was last season.

He got rid of Moyes and we have a LVG as a manager. That's a start.

Maybe so, but BBC have said exactly the same. BBC won't say it unless they have verified with more than one source that it is correct as is their procedure.

We aren't going to get the worlds best due to the calamity of Moyes and Woodward last season. We have to hope Herrera continues his progression, otherwise we'll be scratching around hoping for someone else half way decent.

Yeah, as disappointing as it sounds, you are right and I/we have to accept that. I'm just worried we end up with another player pushing the £30m barrier that doesn't do the job we need and we fail to make progress. Natural aprehension I suppose.
 
I respect Athletic's policy with basque players and all, but if a player really want to leave, why force him to stay if you can't get any more money from doing so? Herrera didn't force his way out last summer, he stayed, made no fuzz about it and helped them make top 4. Show him some appreciation.

Moyes basically just said in an interview that he was the one who didn't want to get Herrera at that price, he was the one who left Fellaini til late on and it's clear that he was the one rejecting Thiago for the unattainable Fabregas.
 
We won't pay all the taxes. We have to find our way around it now or else give up on the player. Athletic won't let him go willingly.

They aren't rich at all. If I am not mistaken their entire revenue is only around 50m pounds or so and they have debt. But agree about the other part, that they want to keep their players at all costs (even if that means benching them, see Llorente). They're cnuts and very stubborn. Bayern apparently had to deal with the goverment there and only after they threatened Bilbao that in case they don't accept Bayern bid (release clause) then the city council will give the money to companies that Bilbao has debt, they made a deal.
 
So is the taxes additional cost the money that Ander has covered himself or at least offered to in order to force the deal?

If we want him, it's the player himself who has to deposit the money to the Spanish League and buy himself out of his contract. That money is subject to tax, most likely we'll give Herrera the money to deposit at the Spanish league, but then that counts as income and thus taxable.
 
It does make many wonder if the club have the money? Because if they are haggling over a million, it is a concern, they got to realise the price will increase in a weeks time, and they can't agree a few now ? Unbelievable
 
It sounds like they actually rejected the deal earlier in the week (not today) but Ander Herrera submitted the documents yesterday so I'm assuming (based on nothing at all) that the documents in question would be us giving the player the money to pay the clause? It's just Bilbao being Bilbao by the sounds of things, political posturing, trying to appear in control.
