Or Woodward offered him a large sign on bonus to compensate him? If he did pay out of his own pocket you'd best believe it was part of negotiations and we'd compensate him for it.
 
YES, sign him up, play him every game, by the second season the commentators and his ratings go through the roof. THE PASS MASTER, MIDFIELD MEASTRO, EVERYTHING GOES THROUGH HIM.

All this nonsense about us letting him pay out the remainder of his clause being unfair etc, isn't that what Javi Martinez did to move to Bayern? Something they do to avoid taxes or some such. @jojojo probably knows.

I think with Martinez, Bayern "gave" Martinez the funds to allow him to buy out his release clause, I think that was how they avoided the taxes from memory. Like you said @jojojo probably knows!

It's different from a transfer.

One you negotiate with the club, agree a fee (probably less than the release clause) and you talk to the player.

The other, the player pays the legally required buy out of his contract and walks away from the club regardless of what they want, usually because the club doesn't want to sell.


The problem is, your average player doesn't have 30 million quid to buy out his release, so has to get the money from the club that wants him, that then raises tax issues, as someone has just paid him 30 million quid.

Well this is embarrassing, two people throw my name in, but I'm going to quote my own posts from the last page in reply :lol:

On the "paying to come" thing. Last summer we had the same rumour. United were willing to offer a fee + add-ons deal to Athletic (with bonuses for things like appearances, cups we win, if he becomes a full international etc). When Athletic wouldn't deal, Ander is supposed to have said he wanted United to give Athletic the cash and he'd take the gamble on being worth the bonuses.

And now one for people wondering about this tax business and how the clubs avoid it. I'll spoiler it, because you need to be a special kind of enthusiast to read it.
Just to be tedious on the release clause thing. There is only one case of a Spanish club (or player) having to pay tax on the deal. It is very difficult to get clear case law on the subject because the actual forced release clause mechanism is almost never used - as it can be troublesome for both the buyer and the seller.

The reason there is ambiguity is because the law itself is ambiguous. I'll leave this in Spanish because the specific interpretation of the words is critical.
El art.2.2 del Libro V dice: “La inscripción de un jugador profesional a favor de una Sociedad Anónima Deportiva o Club será cancelada por la rescisión unilateral del contrato por parte del jugador profesional. En este caso, y si estuviera previsto tal desestimiento con cláusula indemnizatoria en el contrato que dio lugar a la inscripción, se procederá a su cancelación, previo depósito en la LNFP del importe previsto en la indemnización”.

What that appears to say (and why you need specialist lawyers) is that a player can unilaterally cancel his contract. However, it then says that when his old club receives the prescribed compensation his registration can be transferred to his new club. It does not say explicitly that the player must hand over the money himself. Because of this vagueness, lawyers can step in and earn a healthy fee at this point, and then the buying club can hand over the cash on the player's behalf, without the player ever possessing it himself.

The Spanish LFP agreed during the Bayern/Martinez case that the clause should be interpreted as a release clause as described by FIFA.
If a professional is required to pay compensation, the professional and his new club shall be jointly and severally liable for its payment. The amount may be stipulated in the contract or agreed between the parties.

Which again is interpreted as meaning the club can pay the money without the player touching it.

Any lawyers/tax advisors on the board will know this is the contract law equivalent of a minefield for the club/player and a goldmine for the lawyers. As I say, actual case law (as in cases that have gone into tax arbitration or into court) is basically non-existent. So any club using it will be very wary and will probably put an insurance policy in place if the amounts involved are large.

I will be honest, I don't know too much about this guy. but is no one else a bit concerned that he is nearly 25, hasn't played CL and doesn't have a single senior international cap to his name?

Carrick replaced by someone more defensive but who also has a good engine.

No, if you have watched him play you would see that he is a very good player, no tup there with the elite Spanish talent but a very good player. He has technique, skill, size, strength and he is tenacious. He loves a midfield battle, he will do well in this league. Spain have an abundance of talent so it is no slight on him. Bilbao are not a CL club so getting into the Spain squad would be difficult for him. Hopefully he can kick on here but he is a great signing, just the type of player we need.

He had Xabi Alonso, Xavi, Busquets, Fabregas, etc etc etc in his way.

As a CM is there any shame to been kept out of a team by Xabi, Xavi, Iniesta, Fabregas, Busquests and Martinez?

Not sure, I only have it on my Vita and gave up after I accidentally offered 45m for strootman and they wouldnt take my initial 23m offer.....
