And he is right! I watched the game again...Fellaini just knocked it off to Smalling as he dashed forward, leaving Smalling, with no option but to hoof it.

Not really. When a player has a release clause, you've got to expect this sort of thing to happen. It's there for anybody to activate. Bayern is perfectly entitled to activate it. Put anti Bayern clauses in their contracts if you can. Or don't have release/buyout clauses in your players contracts.
