The first point of his rebuttal repeats an error that's popping up all over the place though.
The FA told Jim that it was agreed by all parties INCLUDING Suarez that concha de tu hermana was on this occasion an exclamation like feck me. If it's agreed by the parties it doesn't matter that there could have been other meanings. The Panel is entitled to accept the meaning the parties have agreed.
So for us to get all exercised now about how Evra was allowed to get away with such a foul "insult" is a complete waste of time, because it was a point conceded by Suarez.
Similarly, Suarez and his team elected not to pursue questions of credibility of Evra or his "previous". Then in the club's statement of 20 December we complained that the accusation was not credible, no more so than his previous unfounded allegations. Too bloody late.
There are complaints being made about the late disclosure of evidence as evidence of conspiracy or procedural flaw. But Suarez's team had the chance to adjourn to consider the evidence and said they'd had enough time to consider it. Can't complain now.
We sit around digging up articles that we say show that the FA had prejudged the issue, or that a conviction was inevitable by fair
means or foul, and yet when the Chair of the panel admitted to already having read an article that Suarez's team specifically indicated should not have been read, Suarez's lawyer said he was more than sure the Chair wouldn't be influenced by it.
We moan that inconsistencies in Suarez's evidence were interpreted in the worst possible light, and inconsistencies in the evidence submitted on behalf of Evra weren't taken apart. But Suarez's lawyer agreed a lot of statements that were riddled with inconsistencies.
Alan X has come down extremely hard on posters who have suggested that Surez's defence wasn't the best and that at least contributed to the fact that the Panel was able to find for the FA quite easily. May be AlanX has inside knowledge that explains some of these concessions, and if so I'll happily reconsider. In my opinion ( as a lawyer of 15 years PQE, most of it spent advising on quasi-judicial proceedings which share many of the same legal principles as the FA's disciplinary proceedings) based on what has been said an done to date, I think There were many decisions made by Suarez and his legal team that helped the Panel find against him. I'm putting my experience in there as it was suggested by someone yesterday that we couldn't comment on the way the defence was conducted unless we had some insight. I think I do have some insight as a result of my experience. For what it's worth, my other half ( a villa fan with no particular axe to grind, and a litigator of 14 years experience) formed the same opinion independently. I have never seen a decision where there are so many pointed references to concessions and/or cock ups in the conduct of a defence. It was thoroughly embarrassing reading from a legal point of view.
The legal team even had to admit to bad drafting, FFS. That's excruciating.
The reason I'm posting this is that there are lot of opinions being Put out there about legal arguments that the panel should have
considered, inconsistencies they should have picked up, but this is the advocate's job. The panel has to make judgements based on the case argued in front of it for both sides, not Arguments that it thinks should have been run or arguments that could have been run but weren't.
The Panel may have been itching to find for the FA but we gave them plenty of ammunition to do that. People may say, but there was stuff that happened that isn't in the report like Kenny said. However, we haven't appealed or formally challenged, and so the report is now the record and frankly sniping about it in the media isn't going to affect the record one jot

Liverpool are once again at the centre of a damaging race row after a fan was arrested for allegedly racially abusing Oldham's Tom Adeyemi during the FA Cup clash at Anfield.
Adeyemi was visibly rocked by the abuse directed at him from the Kop and had to be calmed down by referee Neil Swarbrick and Liverpool captain Steven Gerrard and some of his own players.
Eye witnesses overheard one Liverpool supporter shout: 'You f****** black b******' towards the end of the 5-1 victory for the hosts.
So Klanfield now behaving in the fashion to what KKK Dalglish has unleashed. Or maybe its just cultural relevance ... thats just banter on merseyside .... didn't ya know?
I hope KKK realizes what he has done. He has given every genuine card carrying EDL/BNP member or closet racist the platform to use racist words and slurs and this will carry on all season now.
I hope the players abused can take it in their stride but I also hope Liverpool fans continue to play up to the stereotype. What a shambolic disgusting bunch of wankers.
