I'm sure other countries have them as well and it's just because the US politicians are so well known globally, but feck me, they do seem to have a continual stream of dumbass, uneducated and just outright stupid people who get elected.

He either has to put in the whole amount or get a bond, that's 10% so that's $30 + million and he doesn't get that back, if he loses he's still liable for the full amount!

I was on the Trump campaign email list a while for laughs. The number of mails begging for donations and lottery scams was unreal. One way or another he will find a way to grift the money for this from his lunatic supporters.

I don't see this lasting long in the courts TBH - a best he'll get a reduction in the fine, he'll need a goodly part of this sum way before he can grift it

Can someone explain to me why the ban against Trump on doing business in New York was decided to be 3 years? Why is it not more or even a permaban?
 
An investigative journalist on CNN earlier, whose been through his tax returns, said he probably only has about $40m in cash, and a lot of his most valuable are also most profitable & prop up his "empire" so can't be sold.

Permaban if that could even happen would lean to being "harsh" and I would think that would help his appeal. This like you pointed out seems "reasonable" to me as a non lawyer. The financial penalty is specific to the fraudulent amount of money that the creditors "would have gotten" if the financial statements presented for the loans etc. were accurate and not wildly exaggerated.

So it's not like they pulled numbers out of nowhere. And add to the fact they are so defiant; they are not even pretending to be sorry. And the independent monitor installed while the case was ongoing said they see that the business even during the trial still has fraudulent practices and that is in the ruling. They still dont have the correct departments to make sure financials are clean.

The appeals process for this could be like 18 months one of the lawyers was saying on MSNBC earlier. But he has 30 days to put the money up or do the bond regardless. And he already has done that for the first 5 million dollar verdict in the E Jean Carrol case pending appeal.
So he has this money to put up or bond and the second 83 million E Jean Carrol #2 money to put up for appeals.

although no expert in Anglo-American law, this Trump case was civil, hence no criminal sanctions. Hoeneß was criminal law.

I'm not familiar with Anglo American law either.
Still I would have thought, if somebody is found guilty of serious fraud, it will have also some criminal implications. Or am I wrong here?

judging by german law, most definitely, but at least here it‘s two entirely different systems (civil vs criminal). Not necessarily every criminical case is pursued as a civil case and vice versa.

But maybe someone more competent could enlighten us. Thing is, I simply read that the upcoming case against Trump regarding that pornstar is the first criminal law case against a former US president ever, so the recent one can‘t have been one.

In Germany, if I'm am convicted and then insult the judge and court in the way Trump is doing, I'm sure I will face legal consequences.
 
Not necessarily every criminical case is pursued as a civil case and vice versa.

I know. Still I would have thought that severe civil cases will automatically also open a criminal case, if certain points are fulfilled.

What Trump did for many years is a severe crime (at least in my eyes).
In Germany the real estate tycoon Jürgen Schneider got a jail term for a similar fraud in the 90s.
 
I think one of the main reasons why this case was civil and not criminal is because you need far more evidence to prosecute a criminal case. The prosecution decided that although they had evidence, it wasn't enough to guarantee a criminal conviction.

Criminal cases demand a far higher standard of proof and also provide many more avenues for the defendant to wriggle out. Although Trump is clearly guilty of criminal acts, in this recent case it was decided not to go down that route for whatever reason.

Trump obviously has criminal cases coming up where it's clear the prosecution and District Attorney's have far more proof of wrongdoing by Trump himself. The State doesn't like losing high profile cases so the fact criminal charges are being brought in the upcoming trials suggests in those at least, they are far more certain of a conviction. I think in those cases it's because they have a number of witnesses as well as more concrete proof or proof that wouldn't be so easy to get out of.

At least that's my interpretation of things.
 
Let’s be honest, he’s been offered leniency because he’s the former president Just look at how long the FBI spent asking him to return classified documents. Any other citizen would have been in jail by then.

Interesting. I thought the evidence is pretty damning. He inflated the worth of his real estate by increasing the size of the units 3 times. Easy to proof I would have thought.
On the other side, if I remember correctly, he did the opposite when it came to pay taxes.
