I guess he technically could claim he was defending the constitution by arresting a domestic terrorist, refuse to turn over any evidence and claim presumptive innocence.

I imagine the SC would reverse their decision very quickly and Biden would be impeached within 23 hours though.
Yeah, but if his security service in meantime kills the SC GOP judges, that is fine, then the decision cannot be overturned as long as the Democrat judges do not vote to overturn it. And then, if the army under his orders nuke the congress, the congress cannot impeach Biden.

I mean, the orders might get refused, and it might cause a civil war, but there wouldn't be a mechanism to prosecute Biden.

Actually, considering that he is dead in another couple of years anyway, he should try it just for shit and giggles. Might get impeached (and potentially removed), probably the orders will be refused and then Kamala might invoke the 25th amendment, but who knows, it might all succeed.

Trump sentencing in hush-money case delayed until September

A New York judge has delayed Donald Trump’s sentencing until September as his lawyers seek to challenge his conviction after a Supreme Court ruling.

Trump was initially scheduled to be sentenced on 11 July.

His legal team asked for his conviction to be overturned after the nation’s highest court ruled that former presidents had partial immunity for “official” acts during their presidency.

Justice Juan Merchan said on Tuesday that he would issue a decision on the motions by 6 September.

If sentencing is necessary, the judge wrote, it will take place on 18 September.

In May, a New York jury found Trump guilty of 34 felony counts of falsifying business records, making him the first former president ever convicted of a felony.

Prosecutors said Trump had reimbursed his fixer, Michael Cohen, for hush money paid to an adult film star, who claimed she had an affair with Trump. The money, paid on the eve of the 2016 election, was covered up by falsely labeling it as a legal expenses.

It is the first of Trump's four criminal cases to go to trial.

On Monday, the Supreme Court released a bombshell ruling that found Trump - and other former presidents - had immunity from prosecution for "official acts".

The challenge arose from a federal criminal case against Trump, who is accused of trying to overturn results of the 2020 election, but it could have ripple effects in several of his legal battles.

Seeking to leverage this legal victory, Trump's lawyers in the New York case quickly sought to overturn the May conviction.

They said the Supreme Court case is relevant here, because Trump reimbursed Cohen during his first year in the White House, and prosecutors had argued he signed checks to the fixer from the Oval Office itself.

The Manhattan District Attorney's Office, which prosecuted Trump, responded that Trump's argument was "without merit" but asked for a deadline of 24 July to file a response.

An odd one that it's never been talked about more. Guess most assume it to be a political smear campaign since it was dropped. Given what we know about Trump, his best mate Mr. Epstein and just how she describes his behaviour and mannerisms though...
 
She had been waiting for any excuse to get rid of this case. She aided trump the entire time with all the delays. If he wins the Presidency it was going to be washed away anyway. But, this type of interference by these trumpy judges who were deemed unqualified by most of the legal associations in the first place are one of the main reasons for saying there shouldnt be a second term in the first place. Because more of these judges will get put into the system and effect us all for generations.

The fact the same fkin judge being appointed by the guy who is is tried continues to be banana republic levels of justice. The Trias Politica system that looked so good on paper has failed miserably. Separation of powers my ass.

Here's her logic:

"The bottom line is this: The Appointments Clause is a critical constitutional restriction stemming from the separation of powers, and it gives to Congress a considered role in determining the propriety of vesting appointment power for inferior officers. The Special Counsel's position effectively usurps that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty of the separation of powers.​
If the political branches wish to grant the Attorney General power to appoint Special Counsel Smith to investigate and prosecute this action with the full powers of a United States Attorney, there is a valid means by which to do so. He can be appointed and confirmed through the default method prescribed in the Appointments Clause, as Congress has directed for United States Attorneys throughout American history, or Congress can authorize his appointment through the enactment of positive statutory law consistent with the Appointments Clause."​

This is the Appointments Clause:
Article II Section 2 Clause 2 said:
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

She is ruling, I presume, that Congress has not "by law" vested the Appointment of such inferior Officers in....Heads of Departments.

So basically it took her a year to come up with something, which violates the past 30+ years of precedent, is announced on the eve of the RNC. Stallled long enough, having taken on no new evidence whatsoever to ensure that an appeal can't be heard before the election, and obviously a 2nd Trump term will throw this out.

A bit of a slap in the face of the institutionalists, and should very clear spell out what the next 4 years will look like.

I bet she is going to have some lovely bank account balances to retire on after this. Because between this and her last Trump ruling, the state of Florida should stop her practicing law entirely.

What is wrong with Garland and this DOJ? They waited so long to do this and when they did, they didn't cross all the t's and dot all the I's. They are trying to prosecute a former President, FFS. Of course he would have a great legal team what would find any loopholes. Of course there was a chance in Florida that they would be put up against a Trump appointee, or a right wing, Heritage Foundation judge.

Garland sat on his hands for too long with this and the J6 prosecution.

Does is even matter anyway? He will be in power come January 2025 and be incharge of the DOJ. First thing that will be done is to quash all these cases against him.

And even if he somehow doesn't win the election, the SCOTUS ruling will mean that he can claim the documents being moved to Mar-a-Lago were all "official acts". Moving them about to prevent their retrieval will be seem so small fry post election, it won't even be worth prosecuting.
